ITB India misusing confidential information? Injunction against Messe Berlin
An Indian cCourt issued an injunction order against Messe Berlin, organizers of ITB Berlin. The Indian version of ITB was recently launched ITB India.
Fairfest Media Limited, organizers of the biggest travel trade show in India – OTM Mumbai took Messe Berlin, a German company to court for breach of an NDA (Non-Disclosure Agreement), for a proposed collaboration.
Fairfest Media approached the High Court of Bombay earlier, for an Injunction against Messe Berlin, to restrain it from using confidential information including client details distributed to them in confidence.
Fairfest asked for an Injunction to restrain Messe Berlin from conducting ITB India, since it would inevitably take advantage of the confidential and competitive information shared beneath the terms of the NDA. The problem was referred by the High Court to a sole Arbitrator, who after hearing detailed arguments from both relative sides, issued injunction orders restraining Messe Berlin from utilizing the confidential information.
The Arbitrator ruled and only Fairfest and restrained Messe Berlin, the organizer of ITB India, from utilizing the confidential information it obtained from Fairfest. Messe Berlin had challenged the jurisdiction of the Arbitrator.
The Arbitrator ruled that it had jurisdiction on issues linked to the breach of NDA. The Arbitrator also ruled that it didn’t deal with the problems linked to copyright/trademark and additional confidential information obtained by Messe Berlin under a Letter of Intent (LOI) executed later to the NDA, which designated Singapore because the jurisdiction specifically.
Fairfest is, however, considering additional litigation to handle the aforementioned, at appropriate forums in Singapore and in India, for further claims and injunctions for damages according of the breach of the terms of the LOI. The Arbitrator has ordered Messe Berlin to cover costs to Fairfest also.

Messe Berlin had earlier tried to produce a bid to enter Indian markets by way of a co-branded show called BITB in Delhi in 2017, which was discontinued later.
